  2. For the purpose of pursuing the Administrator's legitimate interests (legal basis: Art. 6(1)(f) GDPR), in particular for archival purposes, creating backups, ensuring the security of data stored on the Forum, and for the purpose of pursuing or defending against potential claims,
  3. For sending commercial information to the User at their indicated email address - the legal basis for such processing is the User's consent (legal basis: Art. 6(1)(a) GDPR).

V. Data retention period

  2. Where data is processed for the purpose of pursuing the Administrator's legitimate interests (for archival purposes, creating backups, and other purposes referred to above) - until those interests are fulfilled or the User objects to such processing.
  3. Where consent has been given to receive commercial information electronically - data may be processed for this purpose until such consent is withdrawn.

VI. Disclosure of Users' personal data

  1. Access to Users' personal data is held by the Administrator or persons authorised by the Administrator.
  2. Users' personal data in the scope of the username is also visible to other forum users.
  3. The Administrator may disclose Users' data to entities authorised to receive it under applicable law, i.e. public authorities in connection with proceedings conducted by those authorities (e.g. police, prosecution service, courts), or for the purpose of defending against or pursuing potential claims by the Administrator.
  4. The Administrator may transfer Users' data to entities processing data on behalf of the Administrator (e.g. entities providing hosting services, i.e. webh.pl, ul. 3. the right to data portability,
  4. the right to withdraw consent to the processing of personal data for a specific purpose, where the User has previously given such consent - withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal,
  5. the right to lodge a complaint with the President of the Personal Data Protection Office in connection with the processing of personal data by the Administrator.

VIII. Security of Users' personal data

The Administrator declares that it processes Users' personal data in accordance with the guidelines of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. In particular, the Administrator declares that it has implemented all necessary technical and organisational measures to properly secure Users' personal data.

IX. What are "cookies"?

The term "cookies" refers to small pieces of information, in particular text files, stored on Users' end devices used to access websites. These files allow the user's device to be recognised and the website to be displayed in a way tailored to the user's individual preferences. Cookies typically contain the name of the website they originate from, the duration of their storage on the end device, and a unique identifier.

X. What do we use cookies for?

Cookies are used to tailor the content of websites to user preferences and to optimise the use of websites. They are also used to create anonymous, aggregated statistics that help to understand how users interact with websites, enabling improvements to their structure and content, without personally identifying individual users.

XI. What types of cookies do we use?

In general, two types of cookies are used - "session" cookies and "persistent" cookies. Session cookies are temporary files that remain on the user's device until they log out of the website or close the browser. Persistent cookies remain on the user's device for the period specified in the cookie parameters or until they are manually deleted by the user.

Cookies used by partners of the website operator are subject to their own privacy policies. Cookies can be categorised in detail according to:

A. Types of cookies by necessity to the service

Essential - absolutely necessary for the correct functioning of the website or the features the user wishes to use.

Functional - important for the operation of the service:

  • serve to enhance the functionality of the service; without them the service will work correctly, but will not be tailored to the user's preferences,
  • serve to ensure a high level of functionality of the service; without the settings stored in the cookie, the level of functionality of the website may be reduced, but it should not prevent the user from using it altogether,
  • serve critical functions of the service; blocking them will cause certain features to malfunction.

Business - enable the operation of the business model on which the website is based. Blocking them will not render the service fully unavailable, but may reduce the quality of service as the website owner will be unable to generate the revenue that subsidises the operation of the service. Advertising cookies fall into this category.

B. By duration of storage on the user's end device

Session cookies - placed for the duration of the browser session; deleted when the browser is closed.

Persistent cookies - not deleted when the browser is closed; remain on the user's device for a set period or indefinitely, depending on the website owner's settings.

C. By origin - the service administrator who manages the cookies

First-party cookies - placed directly by the owner of the website being visited.

Third-party cookies - placed by external entities whose page components have been called by the website owner.

Note: cookies may be triggered by the administrator via scripts or components located on a partner's servers, which may be in a different location - a different country or even an entirely different legal system. Where the website administrator calls service components from outside their own system, different cookie policy rules may apply than those set out in the website administrator's own privacy/cookie policy.

D. By purpose

Service configuration - enable the configuration of functions and services on the website.

Security and reliability - enable authentication verification and performance optimisation of the service.

Authentication - enable the website to detect when a user is logged in, so that it can display appropriate information and features.

Session state - enable the recording of information about how users interact with the website. This may relate to the most frequently visited pages or any error messages displayed on certain pages. Cookies used to record "session state" help improve services and enhance the browsing experience.

Processes - enable the smooth operation of the website itself and the features available on it.

Advertising - enable the display of advertisements more relevant to users and more valuable to publishers and advertisers; enable ad personalisation and may also be used to display ads outside the website's own pages.

Location - enable displayed information to be tailored to the user's location.

Analytics, research and audience measurement - enable website owners to better understand their users' preferences and, through analysis, to improve and develop products and services. Typically, the website owner or a research firm collects information anonymously and processes trend data without identifying the personal data of individual users.

E. Types of cookies by impact on user privacy

Harmless - includes cookies:

  • necessary for the correct functioning of the website,
  • needed to enable website functionality, but with no connection to user tracking.

Analytical - used to track users, but do not include information that would allow a specific individual user to be identified.

XII. Do cookies contain personal data?

Personal data collected using cookies may only be gathered for the purpose of performing specific functions for the user. Such data is encrypted in a way that prevents access by unauthorised persons.

XIII. Deleting cookies

By default, web browsing software allows cookies to be placed on the user's end device. These settings can be changed to block the automatic handling of cookies in the browser settings or to notify the user each time cookies are sent to their device. Detailed information about the options and methods for managing cookies is available in the browser settings.

Restricting the use of cookies may affect some of the features available on the website.
